The service
Orb55 designs and builds custom websites for clients. The specific deliverables for your project, and how you pay for them, are defined in the quote or proposal you accept. Where a scope isn't covered by a standard quote, it is agreed with you in writing before work begins.
Payment terms
There are two ways to pay, chosen when you order. Monthly: nothing upfront, with the build, hosting and Website Care covered by one monthly payment. There is no minimum term and you may stop at any time. Pay in full: a 50% deposit to begin and the remaining 50% due before launch. Invoices are payable within 14 days. Prices are in GBP. We accept card and bank transfer.
Ownership & usage rights
On a one-off build, full ownership of the source code and design files transfers to you on final payment. On a monthly plan, ownership transfers when the design is bought out, which happens automatically at no cost after 24 months of payments; until then Orb55 retains ownership while the site remains live and supported. Ownership covers the source code and design files only, not the hosting: when ownership transfers the monthly ends, and with it the hosting, monitoring, backups and security updates it paid for. You may continue those under a separate Website Care plan or host the site yourself. Once ownership has transferred you may edit, extend, host, and migrate the work freely. You may not resell or redistribute the source to third parties as-is. Any third-party assets used in the build (fonts, libraries, plugins) remain governed by their own licences.
Portfolio rights
Unless you ask otherwise in writing before launch, we reserve the right to feature the work on our portfolio, case studies, and social channels, including screenshots, excerpts of the live site, and a brief description of the project.
Revisions & scope
Each quote sets out the rounds of revision included for that project. Additional revisions or significant changes to the agreed scope are quoted separately before work continues, so there are no surprises on either side.
Timelines
Delivery windows are quoted in business days and begin once we've received the assets we need from you (copy, images, logos, domain access). Delays in content delivery may extend the launch date. We'll keep you informed throughout.
Liability
We deliver the work to the best of our professional ability. Our total liability to you for any claim relating to a project is limited to the amount you paid us for that project. We are not liable for indirect or consequential losses, including loss of profit, business, or data.
Termination
You may cancel a project at any time. If you pay in full, the 50% deposit covers work carried out up to the point of cancellation and is non-refundable once work has progressed. If you pay monthly, there is no minimum term and you may stop at any time with 30 days notice. You may take the website with you at any point by buying out the design: the price is the tier's in-full price less 50% of everything you have paid, so it reduces with every payment and reaches zero after 24 months. If you stop without buying out, the site is taken offline and ownership stays with Orb55. If we are materially unable to deliver, you are entitled to a refund of monies paid for work not carried out.
Governing law
These terms are governed by the laws of England and Wales. Any disputes that cannot be resolved informally will fall under the exclusive jurisdiction of the courts of England and Wales.
